These Terms & Conditions (“Terms”) govern participation in the skill based competitions (“Competition”) operated by How Many Beanz (“Promoter”, “we”, “us”, “our”). By entering the Competition, participants (“Entrants”, “you”, “your”) agree to be bound by these Terms.

Nature of the Competition

1.1 This is a game of skill.

1.2 Chance plays no part in determining the winner.

1.3 Entrants must submit a guess to the question displayed (e.g., “How many beans are in the jar?”).

1.4 Only entries that satisfy the skill requirement are eligible to win (i.e. those who provide a guess).

Eligibility

2.1 Entrants must be 18 years or older at the time of entry.

2.2 Entrants must reside in Australia where participation in skill based competitions is lawful. South Australian residents are excluded from entry.

2.3 Employees, contractors, and immediate family members and friends of the Promoter are not eligible to enter.

2.4 The Promoter reserves the right to request proof of age, identity, and residency.

Entry Requirements

4.1 Each entry must include a guess that reflects the Entrant’s own skill and judgement.

4.2 Automated entries are prohibited.

4.3 The Promoter may reject entries that are incomplete, incorrect, fraudulent, or submitted in breach of these Terms.

Competition Period

5.1 Each Competition opens and closes on the dates and times specified on the website.

5.2 Entries received after the closing time are invalid.

5.3 The Promoter may extend or shorten the Competition period if necessary (e.g., technical issues).

Determining the Winner

6.1 After the Competition closes, the Promoter will determine the correct answer (e.g., the actual number of beans in the jar).

6.2 The winner is the Entrant whose guess is correct or closest to the correct answer.

6.3 If two or more Entrants are equally right or close, the winner is the Entrant who submitted their valid entry earliest.

6.4 Only entries that satisfy the skill requirement are eligible.

6.5 The Promoter’s decision is final and no correspondence will be entered into.

Prize and Misc

7.1 The prize for each Competition is described on the website.

7.2 Prizes are not transferable, exchangeable, or redeemable for cash unless stated otherwise.

7.3 Postal/Free Entry Method

To comply with domestic skill competition and sweepstakes standards, a free entry method is available. The entrant must bear the cost of post. 

This must be submitted via physical mail to PO Box 317, Emerald, VIC 3782.    

The postal entry must include:

• Full name
• Email address
• Phone number
• The Competition name (Jar number)
• The Entrant’s guess

Postal entries must be received prior to competition closing. Delays in receiving postal entries may result in the entry not being received in time. 

Postal entries are treated equally.

7.3 The Promoter may substitute a prize of equal or greater value if the original prize becomes unavailable.

7.4 The winner is responsible for any taxes, duties, or additional costs associated with accepting the prize.

Winner Notification

8.1 The winner will be notified via email and/or phone within 30 minutes of the draw.

8.2 The winner’s first name only, Instagram handle and region may be published on the website and social media.

8.3 If the winner does not respond within 7 days, the prize will be awarded to the next closest valid entry.

Verification

9.1 The Promoter may require the winner to provide:

• Proof of identity
• Proof of age
• Proof of residency

9.2 Failure to provide verification may result in disqualification and the runner up being elected.

Refunds & Cancellations

10.1 Entry fees are non refundable except where required by law.

10.2 If the Competition is cancelled, all paid entries will be refunded.

10.3 The Promoter is not responsible for technical issues that prevent entry submission.

Disqualification

The Promoter may disqualify any Entrant who:

• Provides false information
• Attempts to manipulate the Competition
• Uses automated entry methods
• Breaches these Terms

Limitation of Liability

12.1 To the maximum extent permitted by law, the Promoter is not liable for:

• Loss, damage, or injury arising from participation
• Technical failures or website downtime
• Delays in prize delivery
• Incorrect or incomplete entries

12.2 Nothing in these Terms excludes liability for fraud or other liabilities that cannot be excluded by law.

Privacy

13.1 The Promoter collects personal information for the purpose of administering the Competition only.

13.2 Personal information will be handled in accordance with our Privacy Policy.

13.3 Entrants consent to their first name only, Instagram handle (if provided) and region being published if they win.

Intellectual Property

14.1 All website content, images, and materials are owned by the Promoter.

14.2 Entrants may not reproduce or distribute any content without permission.

Changes to Terms

15.1 The Promoter may amend these Terms at any time.

15.2 Updated Terms will be published on the website and apply to all future Competitions.

Governing Law

These Terms are governed by the laws of Victoria, Australia, and Entrants submit to the exclusive jurisdiction of its courts.
